Definitions
Stallion owner: The person or persons or corporation registered as the owner
with the Australian Stud Book or their appointed representatives.
Mare owner: The registered owner or any person authorised in writing to act
on their behalf.
Agent: Persons who transact business in stallion nominations for a fee including
Members of the Federation of Bloodstock Agents Australia Limited or other.
- The submission of an offer shall be deemed a live offer and will constitute
an obligation to pay the service fee detailed in the offer in the event
that a positive response is received to any offer made.
- In the event that
a positive response is received, at that point the
person on whose behalf the offer is made becomes responsible for payment
of both
the service fee stated in the offer and any fees due to Stallion Exchange.
- Payment
of fees due to Stallion Exchange and any other fees or taxes associated
with the transaction, other than the service fee itself,
including any part
payments or deposits required to be paid as part of the service fee,
must be made to the Stallion Exchange within 72 hours of the receipt
of any positive
response.
- Where an offer for a stallion service fee is made by more
than one person or corporation or is made concerning a mare owned by
more than
one person
or corporation, the conditions will apply to and bind each such
person or corporation severally and any two or more such persons or corporations
jointly.
- Where an offer for a stallion service fee is made by a
person acting as an agent for the owner(s) of the mare or mares concerned
in such
offer, such
agent will be bound to meet the conditions applying to the offer,
notwithstanding any obligations of the owner(s) of the mare and
without prejudice to
these obligations.
- The listing of a stallion on the Stallion Exchange
gives, implies or represents no warranty that services to that stallion
are available
or will be available
at any time in the future unless notification of a positive
response to any service fee offer is made by Stallion Exchange, which
represents confirmation
that a service to that stallion is available to the offerer
to which the response is made.
- Whilst all care is taken by Stallion Exchange
and its associates to provide accurate information on payment conditions
of the
agreed service fee, it
is the responsibility of the owner of the mare concerned
in the offer to confirm the conditions of payment with the owner(s)
of the stallion
or his/her/their
nominated representative(s).
- In the event that any dispute
should subsequently arise between the mare owner(s) or the stallion owner(s)
or their
representatives,
fees charged
by and paid to or due to Stallion Exchange will be payable
and non-refundable.
Privacy
statement. Stallion Exchange warrants that any email address provided by any entity
making an offer for a stallion service shall be treated as confidential and
used only for the purpose of negotiating a service contract for the mare
or mares concerned or for contact with Equine United or Stallion Exchange. |
